Terms and Conditions of Sale

By placing an order at laptopsecuritystore.com ("Laptop Security Store"), you ("Customer") agree to be bound by the Terms and Conditions of Sale listed below. You and the Laptop Security Store agree that the following Terms and Conditions are the exclusive terms governing the sales transaction between Customer and the Laptop Security Store. Any attempt to alter, supplement, modify or amend these Terms and Conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these Terms and Conditions of Sale are subject to change at any time, without prior written notice. Therefore, please refer to these Terms and Conditions of Sale each time you place an order with or accept delivery of any goods from the Laptop Security Store.

Order Acceptance
All orders are subject to acceptance by the Laptop Security Store. The Laptop Security Store reserves the right to refuse service to anyone. Receipt of order confirmation or an electronically generated invoice does not signify our acceptance of an order, nor does it constitute confirmation of our offer to sell.

Payment Methods
The Laptop Security Store accepts the following credit cards:
  1. Visa
  2. MasterCard
  3. American Express
  4. Discover
Additionally, you may pay through Google Checkout if you wish.

Credit Terms
The Laptop Security Store, at its sole discretion, may extend Net15, Net20 or Net30 payment terms to qualified customers.

Order Processing
Normally, you can expect your order to be processed within 24-48 hours, provided the items are in stock and there are no problems with payment verification. Though we try to ship orders the same day, the Laptop Security Store does not guarantee same-day shipping. Orders are not processed on weekends and holidays.

Shipping
The Laptop Security Store will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point. Essentially, title to all product(s), except software, and risk of loss passes to the Customer upon delivery to the carrier.

No Shipping to PO Boxes
The Laptop Security Store will not ship products to PO boxes.

Transfer of Title
Title to products passes from the Laptop Security Store to the Customer at the time products are shipped from the Laptop Security Store's facility. Since software is licensed, all title to software remains with the applicable licensor(s).

Insurance
Insurance (provided by the carrier) is manditory for all orders to avoid disputes arising from product damage or loss during transit.

Carriers
The Laptop Security Store uses FedEx, the United States Postal Service, UPS and DHL. You will be given the opportunity to select the shipment method at checkout from one or more of these carriers.

Shipment Methods
The Laptop Security stores will provide some or all of the following shipment method options at checkout.
  • FedEx Standard Overnight - Delivery within 1 business day + 24-48 hours to process the order.
  • FedEx 2Day - Delivery within 2 business days + 24-48 hours to process the order.
  • FedEx Express Saver - 3 business days + 24-48 hours to process the order.
  • FedEx Home Delivery - 5 business days (7 business days for Alaska and Hawaii) + 24-48 hours to process the order.
  • FedEx Ground - 5 business days (7 business days forAlaska and Hawaii) + 24-48 hours to process the order.
  • UPS 2Day - 2 business days + 24-48 hours to process the order.
  • UPS 3Day - 3 business days + 24-48 hours to process the order.
  • UPS Ground - 5 to 7 business days + 24-48 hours to process the order.
Software Download
Some software that the Laptop Security Store sells is distributed electronically, normally through a download/licensing process provided by the manufacturer.

International Orders
The Laptop Security Store is bound by US export restrictions on certain types of products. Additionally, payment verification may be delayed or withheld by our merchant service vendor. As a result, the Laptop Security Store may reject certain international orders.

Order Status
The Laptop Security Store will keep you informed of your order status via e-mail. All tracking information will be emailed to your shipping email address once your order has shipped. You may also acquire your order status and history by logging in to your Laptop Security Store account or by calling us at (877) 463-6333. Standard order status classifications are defined as follows:
Processing - Order has been received, but pending payment authorization or is being prepared for shipment.

Shipped - Order has been shipped by a Laptop Security Store carrier. The "Shipped" status email normally contains a tracking number.

Electronic Delivery - Your order has been processed and passed to the software vendor for fulfillment. You should receive an email containing download links and activation codes within a few days.

Back-ordered - The product you ordered is out of stock. The Laptop Security Store is awaiting a shipment from the manufacturer and will ship your product once it is received.

Product Discontinued - The product you ordered is out of stock and has been discontinued. Either the Laptop Security Store will subtitute a similar product or you will be given the option of obtaining a refund.
Returns and Exchanges
The Laptop Security Store provides a 30 day return policy for unopened software product, hardware and accesories. The 30 day period begins on the date of purchase.

Downloadable Software
ALL SOFTWARE SALES DISTRIBUTED THROUGH ELECTRONIC DOWNLOADS ARE FINAL. The Laptop Security Store cannot accept returns for downloadable software.

Defective Products
Defective products will be exchanged during the same 30 days period for either the same or a similar product if the original product is no longer available. All exchanges for alternate products will be either granted or denied at the sole discretion of the Laptop Security Store. If a defective product is exchanged for a product that is of a lesser Manufacturer's Suggested Retail Price (MSRP), the Laptop Security Store will refund the difference of the two product's MSRPs.

Return Authorization
In order to receive a refund or product exchange, you must obtain a Return Material Authorization (RMA) number from the Laptop Security Store by calling us at (877) 463-6333 within the 30 day return/exchange period. RMA numbers must be clearly marked on the shipping label and packaging. Returns will not be accepted without an RMA number.

Restocking Fee
The Laptop Security Store will charge a 15% restocking fee for returned or exchanged products.

Shipping Charges
All shipping charges and costs incurred in returning Product(s) to the Laptop Security Store and sending replacement product(s) to the Customer, including insurance, duties or other fees will be prepaid by Customer and will not be refunded by the Laptop Security Store. The Customer will assume all risk of loss or damage to Product(s) while in transit to the Laptop Security Store.

Product Descriptions
Price, specifications and terms of offers are subject to change without notice. The Laptop Security Store is not responsible for typographical and/or photographical errors in product descriptions.

Warranty
Most retail products are accompanied by the original manufacturer's warranty.

PRODUCTS SOLD BY THE LAPTOP SECURITY STORE ARE NOT MANUFACTURED BY THE LAPTOP SECURITY STORE. THE PRODUCTS MAY, HOWEVER, BE COVERED BY EACH MANUFACTURER'S WARRANTY, SERVICE, AND SUPPORT POLICY (IF PRESENT). THE LAPTOP SECURITY STORE ASSIGNS AND PASSES THROUGH TO THE CUSTOMER ANY WARRANTY OF THE MANUFACTURER, AND CUSTOMER ACKNOWLEDGES THAT IT SHALL HAVE RECOURSE ONLY UNDER SUCH WARRANTIES AND ONLY AS AGAINST THE MANUFACTURER OF THE PRODUCTS.

THE LAPTOP SECURITY STORE MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN ITS WEBSITE. THE LAPTOP SECURITY STORE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.

ALL ITEMS SOLD THROUGH THE LAPTOP SECURITY STORE ARE SOLD "AS IS" OR "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THESE ITEMS IS WITH THE Customer. SHOULD ANY OF THESE ITEMS PROVE DEFECTIVE, DO NOT FUNCTION, OR FUNCTION IMPROPERLY IN ANY WAY FOLLOWING THE EXPIRATION OF THE MANUFACTURER'S WARRANTY (IF ANY), THE Customer, AND NOT THE MANUFACTURER, DISTRIBUTOR, OR THE LAPTOP SECURITY STORE, ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.

Force Majeure
The Laptop Security Store shall not be liable for any delay in performance directly or indirectly caused by or resulting from acts of nature, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labor difficulties, equipment failure, late deliveries by suppliers or other difficulties which are beyond the control, and without the fault of the Laptop Security Store. Quantities are subject to availability. In the event of production difficulties or product shortages, Seller may allocate sales and deliveries at its sole discretion.

Limitation of Liability
IN ALL CIRCUMSTANCES THE LAPTOP SECIRTY STORE'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. THE LAPTOP SECURITY STORE SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. THE LAPTOP SECURITY STORE SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT THE LAPTOP SECURITY STORE HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Governing Law
This agreement is governed by the laws of the State of Texas, without regard to its conflict or choice of law provisions. Customer agrees that Texas courts have jurisdiction over this agreement. In the event the Customer and the Laptop Security Store are unable to resolve a customer dispute, and a collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover reasonable attorneys' fees and related costs.

Assignment
Customer may not assign its rights or obligations hereunder without the express prior written consent of Seller.

Entire Agreement
The Terms and Conditions of Sale constitute the entire agreement with regard to this sale and expressly supersede and replace any prior or contemporaneous agreements, whether written or oral, relating to said sale, including any terms and conditions on any of Customer's documents or purchase orders. This agreement shall be binding upon the heirs, successors and assigns of the parties hereto. If any provision of this agreement shall be held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.
